1. Acceptance of Terms

By accessing or using the services provided by EZ Biz Services (“we,” “us,” or “our”), including our website at ezbizservices.com and any related services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

EZ Biz Services provides AI-powered front office automation for service businesses. Our services include:

  • AI receptionist that answers calls 24/7 on your behalf
  • Missed call text-back to capture customers you would otherwise lose
  • Automated appointment scheduling and calendar management
  • Customer follow-ups, reminders, and satisfaction checks
  • SMS and email communications sent on your behalf
  • CRM, pipeline management, and weekly reporting

The specific features available to you depend on your subscription plan.

3. Subscription and Billing

Our services are offered on a subscription basis with three tiers:

  • Starter: $149/month
  • Pro: $297/month
  • Scale: $497/month

Subscriptions are billed monthly and automatically renew at the start of each billing cycle. Payments are processed through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial months, except during the 30-day money-back guarantee period for new subscribers. Additional AI call minutes beyond your plan's allotment are billed at $0.50 per minute.

4. Account Responsibilities

To use our services, you must provide accurate and complete information during signup. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

5. Acceptable Use

Our services are intended for legitimate business use only. You agree not to:

  • Use our services for any illegal, fraudulent, or deceptive purpose
  • Send unsolicited or unauthorized communications (spam) through our platform
  • Abuse, harass, or misuse the AI system (e.g., attempting to manipulate it for unintended purposes)
  • Interfere with or disrupt the platform's operation or security
  • Attempt to gain unauthorized access to our systems, networks, or other users' data
  • Resell or redistribute our services without written permission
  • Use our services in violation of any applicable laws or regulations, including TCPA, CAN-SPAM, and state telemarketing laws

6. Text Messaging Terms

Our platform sends text messages on your behalf to your customers (appointment confirmations, reminders, follow-ups, etc.). By using our SMS features:

  • You confirm that you have obtained appropriate consent from your customers to receive these messages
  • Message and data rates may apply to recipients. Message frequency varies
  • Recipients may opt out at any time by replying STOP
  • Reply HELP for assistance
  • Carriers are not liable for delayed or undelivered messages

You are responsible for ensuring your use of SMS through our platform complies with all applicable laws, including the TCPA.

7. Service Availability

We strive to keep our services available 24/7, but we do not guarantee uninterrupted access. Our services are provided on a best-effort basis. We may experience downtime due to maintenance, updates, or circumstances beyond our control (third-party provider outages, network issues, etc.). We do not offer formal SLA guarantees at this time. We will make reasonable efforts to notify you of planned maintenance in advance.

8. Intellectual Property

Our platform: All technology, software, designs, and content that make up the EZ Biz Services platform are owned by us and protected by applicable intellectual property laws. You may not copy, modify, or create derivative works from our platform without written permission.

Your data: You own all data you provide to us and all data generated through your use of our services (call recordings, customer information, appointment records, etc.). We do not claim ownership of your business data. We use your data solely to provide and improve the services you subscribe to.

9. Limitation of Liability

To the fullest extent permitted by law, EZ Biz Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of our services. This includes but is not limited to: missed calls due to system outages, incorrect AI responses, scheduling errors, or failed message delivery.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI responses will be error-free, that the service will be uninterrupted, or that it will meet all of your specific requirements.

11. Indemnification

You agree to indemnify and hold harmless EZ Biz Services, its owner, and its agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time:

  • You may cancel your subscription at any time through your account or by contacting us. Cancellation takes effect at the end of the current billing period.
  • We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in activity that harms our platform or other users.

Upon termination, you may request an export of your data (call recordings, customer records, appointment history) within 90 days. After 90 days, your data will be permanently deleted. Contact [email protected] to request a data export.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Forrest County, Mississippi.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
